As an emergency physician you work tirelessly to protect your communities, often times putting your life on the line, most notably during this ongoing pandemic. It is critical that you are protected as you go above and beyond the call of duty.

As such, ACOEP supports the “Coronavirus Provider Protection Act,” bipartisan legislation which provides liability protection against unwarranted legal action for care provided while responding to the COVID-19 crisis. Much of this care was provided with limited resources in extraordinary circumstances.

This Bill, H.R. 7059, is bipartisan legislation introduced by Representatives Phil Roe (R-TN), and Lou Correa (D-CA) is a continuation of protections written into the CARES Act.

The bill seeks to protect physicians and other emergency medicine professionals for services provided during the emergency declaration and for 60 days after; it accounts for Federal, State, and local guidelines; and protects treatment administered or denied due to a lack of resources attributed to COVID-19. This Bill is careful to exclude instances of willful misconduct or gross negligence.

It is of vital importance that our communities protect the men and women who ran directly into the chaos of the pandemic in order to save the lives of our communities.
